Consumer Fraud

In 2009, the Iowa legislature joined forty-nine other states which had already adopted a private cause of action for consumer fraud.  Under Chapter 714H, the Iowa consumer fraud statute, a consumer who suffers a loss of money or property as a result of an unfair practice, deception, a false promise or fraud may pursue a private cause of action for consumer fraud.  The Iowa statute is the first step in bringing the same rights to the citizens of Iowa as what exists in other states.  However, the Iowa statute excludes certain businesses from the scope of the prohibited practices.  If a multitude of Iowa consumers are the victim of the same deception or false promise, they may bring the suit together in a class action if such a class action is approved by the Iowa Attorney General.
